These Terms of Service govern your access to and use of FanXess. By creating an account or using the platform, you agree to these terms.

Eligibility and accounts

You must be legally permitted to use the service and provide accurate account information. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.

Platform services

FanXess may allow users to publish content, subscribe, send tips, book services, purchase digital or physical offerings, join live experiences, and communicate through platform tools. Features may change over time.

Creator content and responsibility

Creators remain responsible for the content, listings, services, pricing, disclosures, and promises they publish. By posting content on FanXess, you grant us the rights needed to host, display, distribute, and operate that content within the service.

Payments, subscriptions, and orders

Paid features may include subscriptions, one-time purchases, bookings, tips, deposits, marketplace transactions, or other paid interactions. Fees, commissions, payment timing, payout timing, and refund rules may apply depending on the feature used.

Prohibited conduct

You may not use FanXess for unlawful conduct, fraud, intellectual property infringement, harassment, impersonation, payment abuse, security violations, or content that breaches our platform rules or applicable law.

Moderation and enforcement

We may review, restrict, suspend, remove, refund, block, or terminate accounts, listings, content, transactions, or access where we believe it is necessary for safety, compliance, abuse prevention, or enforcement of these terms.

Third-party services

Some parts of FanXess rely on third-party providers such as payment, analytics, media, security, communication, or verification services. We are not responsible for the independent terms or practices of those providers.

Disclaimers and liability

The service is provided on an as-available basis to the fullest extent permitted by law. To the extent permitted by applicable law, FanXess is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from platform use, third-party services, creator conduct, or user-generated content.

Termination

You may stop using the platform at any time. We may suspend or terminate access where necessary to protect the platform, users, or legal compliance.

Governing law

These terms are governed by Dutch law, except where mandatory consumer law in your place of residence provides otherwise.

Content Review and Pre-Screening

FanXess may review all user-uploaded content before publication and may also review content after publication. Review may be performed manually, through automated systems, or through a combination of both. The purpose of this review is to help confirm that content is lawful, that all persons depicted are adults, that required permissions and records are in place, and that the content complies with our Terms of Service, Community Standards, payment processor requirements, and applicable law. FanXess may reject, delay, remove, restrict, demonetize, or disable access to any content at any time where we believe, in our sole but reasonable judgment, that the content may violate these requirements.

Complaints and Content Removal Policy

Illegal content, non-consensual content, underage content, intellectual property complaints, impersonation, trafficking concerns, and other policy violations may be reported through our Content Removal Request form at /content-removal-request or by contacting [email protected]. We will acknowledge receipt of credible complaints and will use reasonable efforts to review, decide, and resolve each complaint within five (5) business days.

Our review process may include confirming the complainant's identity or authority, reviewing the reported URL or content identifier, preserving relevant evidence, temporarily restricting access to the content, contacting the uploading user or creator, requesting proof of age, consent, licensing, or 18 U.S.C. 2257 records, and escalating the matter to trained compliance personnel, payment processors, legal counsel, law enforcement, or child protection authorities where appropriate.

Possible outcomes include no action, warning, content restriction, content removal, account suspension or termination, cancellation or refund of affected transactions where appropriate, reporting to relevant authorities, and preservation of records for legal or compliance purposes. We may remove or disable content immediately while a complaint is under review if the reported content appears unlawful, non-consensual, exploitative, or otherwise high risk.

Appeals and Depicted-Person Removal Rights

Any person depicted in content hosted on FanXess may request removal of that content if they did not give valid consent, if consent has been withdrawn where withdrawal is legally permitted, if the content was published outside the scope of the consent given, or if the person believes the content is otherwise unlawful. Creators must cooperate with these reviews and provide proof of age, identity, consent, release, and authorization upon request.

If FanXess removes content or takes account action, the affected creator may appeal by responding to the complaint decision or contacting [email protected] with relevant evidence. Appeals will be reviewed by personnel not directly responsible for the original decision where reasonably possible. If there is a genuine disagreement between a depicted person and a creator about consent, authorization, or the right to publish the content, the dispute may be referred to a neutral third-party dispute resolution body, mediator, arbitrator, competent court, or other independent authority selected by FanXess or required by applicable law. Pending final resolution, FanXess may keep the content removed or restricted.

Anti-Human Trafficking and Exploitation

FanXess maintains a zero-tolerance policy toward human trafficking, sex trafficking, forced labor, coercion, modern slavery, child exploitation, and any activity that facilitates exploitation. Users may not upload, promote, sell, request, advertise, or facilitate content or services connected to trafficking or exploitation. Suspected trafficking or exploitation may result in immediate content removal, account termination, preservation of evidence, and reporting to law enforcement or appropriate authorities.

18 U.S.C. 2257 and Age-Verification Record-Keeping

Creators are solely responsible for ensuring that every person depicted in content they upload, sell, stream, publish, submit, or otherwise make available through FanXess is at least eighteen (18) years old or the age of majority in the person's jurisdiction, whichever is greater. Creators must obtain and maintain legally sufficient age-verification records, written consent, model releases, licenses, and authorizations for every person depicted and must provide those records to FanXess promptly upon request.

To the extent any content is subject to 18 U.S.C. §§ 2257 or 2257A and related regulations, the applicable primary producer or creator is responsible for maintaining required records and making any required custodian-of-records statement. FanXess is not the primary producer of user-generated creator content unless expressly stated otherwise. To the extent FanXess is deemed a producer or record keeper for any content, FanXess will maintain or require access to records as required by applicable law. Content for which required age, identity, consent, or 2257-related records cannot be verified may be rejected, removed, or reported.
